1. Acceptance of Terms
By accessing and using the services provided by Powercore ("Service"), you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you may not access the Service.
2. Property Feasibility Analyses & Consultations
Any preliminary property analysis, load capacity review, or California utility rule evaluation provided by Powercore is strictly for informational and structural assessment purposes based on user-submitted parameters. Final system designs, engineering blueprints, and utility interconnection commitments are subject to formal on-site structural engineering verification and utility approval queues.
3. Data Collection & Use for Pre-Qualification
By submitting information through our intake forms, you acknowledge that Powercore collects Utility Data, Property Data, Utility Bill Data, Property Condition Data, Personal Income Data, and Credit Score Data solely for the purpose of pre-qualifying your property and entity for state-mandated utility subsidies, rebate programs, and third-party financing options. Powercore is NOT a Consumer Reporting Agency under the Fair Credit Reporting Act (FCRA). No data collected is used to generate consumer credit reports or determine creditworthiness outside of energy project financing pre-qualification.
4. Consent to Automated & AI-Assisted Communications
By providing your phone number and clicking the opt-in checkbox on any Powercore form, you grant Powercore, its representatives, affiliates, and automated AI systems — including AI voice bots, synthetic speech agents, and conversational text bots — express written consent to contact you via outbound telephone calls (including artificial or pre-recorded voice technology), automated voicemails, and SMS/MMS text messages for marketing, scheduling, project tracking, and consultation purposes.
Voluntary Consent: This consent is completely voluntary and is not a strict condition of purchasing any equipment or services from Powercore. This provision is made in compliance with the Telephone Consumer Protection Act (TCPA), 47 U.S.C. ยง 227, and applicable FCC regulations.
5. Mobile Data & A2P 10DLC Non-Sharing Compliance
All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared, sold, or leased to any third parties, affiliates, or partners for marketing or promotional purposes.
You may revoke consent or opt out at any time by replying "STOP" to any text message, verbally stating "opt-out" to an AI voice agent (which will immediately add you to Powercore's internal Do Not Call registry), or emailing [email protected].
Message frequency varies. Message and data rates may apply. Text HELP for help at any time. Carriers are not liable for delayed or undelivered messages. Consent to receive text messages is not a condition of purchasing any goods or services.
6. Intellectual Property
The Service and its original content, structural layout components, streaming video configurations, and design aesthetics are and will remain the exclusive property of Powercore and its licensors.
7. Limitation of Liability
In no event shall Powercore, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
8. Governing Law
These Terms shall be governed and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
